Introduction

Following the entry into force of the European legislation GDPR, our company informs you in a transparent way about the use that is made of the personal and electronic communications data that you entrusted to us.

1. User data registered in Sylaps software

Personal information about B2C and B2B users of Sylaps (the "Service") are registered by Sylaps Inc who is the Data Controller (the "Data Controller" or "Sylaps Inc"). The purpose of this collection and storage of personal data (IP address, connection times, equipment, email, pseudonym and social network identifier) ​​is the technical management of user authentication and management of legal traceability. Only the personnel in charge of maintenance can access the recorded data. The maximum period of retention of user data is set at 5 years after inactivity on the software. For legal traceability, data are kept for one year.

The legal basis for the use and processing of personal data may be:

  • The performance of a service contract;
  • Or the execution of the conditions of use;
  • Or our legitimate interest as a software publisher (especially security);
  • Or the legitimate interest of our B2C or B2B customers;
  • Or compliance with regulatory standards to be respected by our customers;
  • Or any legal obligation related to legislation in force, in particular Decree No. 2006-358 of 24 March 2006 on the retention of electronic communications data.

We point out the use of several Privacy Shield approved tools that can transmit data from our customers outside the European Union: Mailchimp, Amazon Web Services.

2. Data of working interlocutors at our B2B customers

Personal information about working contacts at our B2B customers is recorded by the Data Controller. The purpose of this collection and storage of personal data (name, first name, professional e-mail, professional telephone, function, questions asked and associated answers ...) is the management of the customer relationship, customer support, project tracking and the associated billing. Only the management, the accounting department and the internal staff in relation to the customers can access the necessary data. The maximum period of retention of personal data is fixed at 5 years after the end of the contractual relationship or inactivity of the relationship. We point out the use of several approved Privacy Shield or Binding Corporate Rules (BCR) approved tools (which guarantee the protection of privacy) that can transmit the data of our customers outside the European Union: Google Apps, QuickBook, Docusign, Amazon Web Services , Mailchimp.

The legal basis for the use and processing of personal data may be based on:

  • The performance of a service contract;
  • Or the execution of the conditions of use;
  • Or our legitimate interest as a software publisher;
  • Or compliance with regulatory standards to be respected by our customers;
  • Or any legal obligation related to legislation in force.

3. Prospect data, request for information and quotation

Personal information about our B2B prospects is recorded by the Data Controller. The purpose of this collection and storage of personal data (last name, first name, professional e-mail, professional telephone, function, questions asked and associated answers ...) is the management of the prospect relationship and the pre-contractual management. Only Management and sales staff can access the necessary data. The maximum period of retention of personal data is fixed at 3 years after inactivity of the relationship. We point out the use of several approved Privacy Shield or Binding Corporate Rules (BCR) approved tools (which guarantee the protection of privacy) which can transmit the data of our customers outside the European Union: Google Apps, Docusign, Amazon Web Services, Mailchimp.

The legal basis for the use and processing of personal data may be based on:

  • The consent of the persons concerned;
  • The execution of a confidentiality agreement;
  • Or the execution of the conditions of use;
  • Or our legitimate interest as a software publisher;
  • Or compliance with regulatory standards to be respected by our customers;
  • Or any legal obligation related to legislation in force.

We point out that we are likely to enrich our prospect database with public information, in particular via participation in exhibitions.

4. Directory and directory of contacts-partners

A listing-partner system (potential or active) has been set up by the Data Controller. The purpose of this registration which contains personal data (name, first name, function, telephone, e-mail ...) is the management of the relationship-partner. Only the Management and the personnel concerned are authorized to have access to the data communicated or recorded. We inform our partners that we are likely to enrich our data with public information. The retention period of personal data is fixed at 5 years after inactivity. The legal basis for the use and processing of personal data is the consent of the persons concerned or our legitimate interest as a company.

5. Referenced or potential supplier data

The identity of the contact persons at our referenced or potential suppliers, all the documents or data provided to become suppliers and the accounting documents of our suppliers are collected by Sylaps (who is the controller) for the management of the supplier relationship and accounting. Only the Management, the personnel in charge of the purchases, projects related to a supplier, the accounting service are authorized to have access to the recorded or communicated data. The maximum retention period for data is 3 years for potential suppliers, 5 years after the last purchase for active suppliers and 10 years for accounting documents. The legal basis for the use and processing of your personal data is based on the consent of the relevant interlocutors or our legitimate interest as a buyer or the execution of a purchase contract. We note that, in rare cases, we are likely to enrich our active or potential supplier data with public information.

6. Transactional email, Newsletters and event invitations

Our consenting users, our customers and our professional interlocutors (suppliers, institutions, partners, ...) are likely to receive our informative or commercial communications by e-mail, phone or mail. In this context, a system of newsletter or listing of guests can be set up by Sylaps who is the controller. You can report to privacy@sylaps.com that you no longer wish to receive our communications. The purpose of this registration which contains personal data (name, first name, address, function, telephone, email, ...) is the dissemination of news or commercial offers or the organizational and promotional management of events. Only the Management and the personnel concerned are authorized to have access to the data communicated or recorded. We note that, in rare cases, we are likely to enrich our invitation data with public information (for example from the trade register) and to transfer data to outsourced event organization companies. We also mention the use of Privacy Shield approved tools that can send data and newsletters outside the European Union, including Mailchimp, Amazon Simple Email Service and Google Apps. The retention period of the personal data is fixed at 3 years after inactivity of the relation with the guests or the subscribers. The legal basis for the use and processing of personal data is the consent of the relevant interlocutors or our legitimate interest as a company or the legitimate interest of the data subject.

7. Job Application or Internship Application

Your CV, any possible letter of motivation and all the other documents or data provided during an application (spontaneous or not) to a job as well as the possible data provided by the former employers are collected by Sylaps (who are responsible for the treatment spouses) in order to assess the adequacy of a professional profile in relation to a potential position to be filled. Only the relevant service and team managers, the relevant HR staff and the Management are authorized to have access to the data communicated. The maximum duration of data retention is fixed at 2 years after inactivity of the relationship with the candidate. The legal basis for the use and processing of your personal data is based on your consent or your legitimate interest as a jobseeker or our legitimate interest as a recruiter. We note that, in rare cases, we transfer CVs to institutional partners or carrying out similar, related or complementary activities. We point out that we are likely to enrich our candidate database with public information or recruitment firms. We note that applications may transit outside the European via Amazon Web Services, Google Apps and Mailchimp enabled Privacy Shield solutions that guarantee the protection of privacy.

8. Traceability of phone calls

A traceability system for telephone calls (with or without audio or video recording) has been set up by Sylaps, which is the controller. The purpose of this registration which contains personal data (incoming or outgoing calls and duration of calls) is the control of abusive expenses and the management of possible litigation. Only the Management and the technical teams concerned are authorized to have access to the data communicated or recorded. The retention period for personal data is 1 year. The legal basis for the use and processing of personal data is based on our legitimate interest as a telecommunications operator.

9. Secure IT Architecture

Our data, those of our customers and those of our users are hosted or transited either in Europe or outside Europe in our outsourced data centers majority ISO 27001 certified (including Google Apps and Amazon Web Service) authorized to receive European personal data via adequations or Privacy Shield certifications or Binding Corporate Rules (BCR) approvals.

10. Use of cookies

Our Service uses cookies to differentiate you from other users of our website. This allows us to offer you better service when you browse our website and also improve our website.

A cookie is a small file containing letters and numbers, stored on your browser or on the hard drive of your computer, if you accept it. Cookies contain information that is transferred to your computer's hard drive.

11. Miscellaneous

Single Sign-On You can log in to Sylaps using sign-in services such as Google, Facebook or an Open ID provider. These services will authenticate your identity and provide you the option to share certain Personal Information with us such as your name and email address to pre-populate our sign up form. You are agreeing to be bound to the third party’s Privacy Policy when you link your Sylaps's account to your third party account.

12. Your rights

We inform that information about our interlocutors of any type (customers, users, suppliers, partners, ...) are likely to be transferred to litigation or control partners: outsourced lawyers, accounting firms and institutions.

In application of European laws and the law of January 6, 1978 (relating to data, files and freedoms), you have the rights of access, rectification, limitation, portability and deletion of your personal data as well as the right to oppose their treatment for legitimate reasons.
